Trial Date Set in Mayoral Write-in Dispute

A Jan. 31 start date has been set for a trial to determine whether San Diego’s sitting mayor, Dick Murphy, should be replaced with San Diego City Councilwoman Donna Frye, the write-in candidate.

Orange County Superior Court Judge Michael Brenner’s ruling Jan. 24 involved two lawsuits challenging the county’s registrar of voters for disqualifying ballots on which a bubble wasn’t filled in next to Frye’s name.

At issue are some 5,547 Frye ballots with unmarked bubbles, which, if counted, would outnumber Murphy’s 2,108 margin of victory in the Nov. 2 election.

Brenner was assigned the case after all the judges on the San Diego Superior Court bench were recused to avoid the appearance of conflict. Murphy had served as a judge there before his election as mayor in 2000.
