Technology Bills Moving Through Congress

Federal anti-spam legislation is headed to the U.S. House of Representatives after a bill was approved last week by the House Commerce Committee.

The bill, HR-3113, the Unsolicited Commercial Electronic Mail Act of 2000, would allow Internet Service Providers and consumers to sue E-mail spammers for up to $150,000 per violation of a posted no spam policy or for failing to comply with an individual E-mail user’s request to be omitted from future mailings.

Another piece of legislation, the Electronic Signatures in Global and National Commerce Act, recently was approved by the House. The act establishes a nationwide standard for digital signatures so that businesses and consumers can have greater confidence in E-commerce transactions. The bill, dubbed “E-SIGN,” creates an equivalence between a handwritten signature on paper records and an electronic signature on electronic records. Many states have already adopted standards for digital signatures, which have caused confusion about governing E-commerce transactions.
