State Panel Denies Encinitas Rental Ordinance

The California Coastal Commission, voting Nov. 14, struck down an Encinitas city ordinance seeking to prohibit new, short-term vacation rentals.

The Coastal Commission stated in a letter that Encinitas residents are concerned about short-term rentals “degrading” the “residential character” of residential areas.

The city created an ordinance to ban new short-term rentals in residential zones that went into effect in August.

The commission said in the letter that, while problems may exist with short-term rentals, the city did not establish that short-term rentals significantly degrade residential character.

The letter also mentioned that a prohibition on short-term rentals could adversely impact public access to beaches and visitor-serving opportunities.

Landlords and property management companies can find short-term vacation rental applications on the city of Encinitas Web site at www.ci.encinitas.ca.us.
