SkinMedica Files Patent Suit Against Histogen

SkinMedica, a privately held Carlsbad-based skin care company, said Jan. 22 it filed a lawsuit against San Diego-based biotech company Histogen seeking unspecified damages and an injunction against the company.

The lawsuit comes as Histogen prepares to launch a line of hair regrowth products, known as Regenica, through dermatologists, plastic surgeons and skin specialists.

The suit alleges that Histogen, formed in 2007 by Gail Naughton following the demise of bankrupt biotech Advanced Tissue Sciences in 2002, infringed on its patented NouriCel technology, a type of cell culture medium used in SkinMedica’s line of anti-aging products. Naughton is listed as the inventor of the cell culture medium.

SkinMedica acquired the NouriCel technology and other associated intellectual properties from Advanced Tissue Sciences in January 2003, according to court documents.

The complaint, filed in U.S. District Court for the Southern District of California, also seeks relief for alleged trade secret misappropriation.
