Jury Finds Illumina Infringed Five Patents

A federal jury March 13 found that lab equipment made by San Diego-based Illumina Inc. infringed five patents held by Santa Clara-based Affymetrix Inc. The jury, in U.S. District Court in Delaware, ordered Illumina to pay $16.7 million in damages.

Illumina and Affymetrix make tools to analyze genetic information.

Illumina’s chief executive, Jay Flatley, said in a statement released March 13 that his company planned to appeal the verdict, and that other information makes the verdict “preliminary.”

The trial will continue later this year. Affymetrix said the trial may address the issue of whether the infringement was willful.

Illumina trades on the Nasdaq as ILMN. Shares stood at $29.09 in midday trading March 14, up 23 cents from the previous day’s close.
